Rape is charge reserved for individuals who;

1. forces another to engage in sexual intercourse.

2. performs non consensual sexual intercourse with another.

3. performs sexual intercourse with another who is incapacitated, disabled, or unable to give consent.

Level 3 Felony

Sentence: 120 minutes

Fine: $15,000

Level 1 Felony if a deadly weapon is used.

Sentence: 240 minutes

Fine: $25,000
