SA(8)23 Driving Under the Influence (DUI)

1. person who drives a vehicle or operates heavy machinery while under the influence of alcohol at or above the legal limit of 0.08 percent BAV

2. A person who drives a vehicle or operates heavy machinery requiring a commercial driver's license while under the influence of alcohol at or above the legal limit of 0.04 percent BAV

3. A person who is under the age of 21 and drives a vehicle or operates heavy machinery while under the influence of alcohol at or above the legal limit of 0.05 percent BAV

4. A person who drives or operates heavy machinery under the influence of awareness-altering drugs, regardless of whether those drugs are being used under a prescription.

5. Aggravating Factors include;

   1. Causing serious bodily injury

   2. Second DUI Offense within 3 months (IRL time)

Class C Misdemeanor (1st Offense, No Aggravating Factors)

Sentence: 5 minutes

Fine: $500

Class A Misdemeanor (1st Offense, Endangerment)

Sentence: 20 minutes

Fine: $5,000

Level 6 Felony (Repeat Offense OR Aggravating Factors)

Sentence: 30 minutes

Fine: $5,000

Level 5 Felony (Serious Injury OR Death)

Sentence: 40 minutes

Fine: $7,500
