SA (2)02 Criminal Trespass

Criminal Trespass is a charge reserved for individuals who either dwell or refuse to leave a property at the request of the owner.

A person can be charged with Criminal Trespass if:

  1. The individual refuses to leave a property that they have no contractual interest in, at the request of the property owner.

  2. The individual enters a dwelling without the permission of the property owner.
