SA (1)02 Assault

Assault is a charge that is reserved for individuals who put another person in fear of imminent bodily harm.

A person can be charged with Assault if:

  1. The individual threatens to cause imminent bodily injury or death to another person.

    1. This charge is different from SA (1)01 via the distance from the other person that the threats are made.

      1. The victim must have been in reasonable fear that they were going to be harmed immediately after the threat was made.

  2. The individual must not have injured the victim.

    1. If the victim is injured, file a battery or aggravated battery charge.

Examples

  1. Attempting to punch, kick, or any other means of harm to another person, without actively making contact

  2. Any other threats that are made within close proximity to the intended victim
