SA (1)08 Voluntary Manslaughter

Voluntary Manslaughter is a charge that is reserved for individuals who kill another person with no prior intent to harm or kill, but under a sudden circumstance that made them mentally or emotionally distraught.

Person can be charged with Voluntary Manslaughter if:

  1. The individual kills a person without prior intent to harm or kill

    1. This is also referred to as “Heat of Passion”.

    2. Examples:

      1. Finding a s/o in an affair, and causes the person to kill the victim out of anger.

This charge CANNOT stack with;
