SA (1)13 Accessory in Commission of a Crime

Accessory in Commission of a Crime is a charge that is reserved for individuals who assisted in the completion of a criminal offense.

A person can be charged with ACC when;

1. The individual was at the scene where the criminal offense took place.

2. The individual committed the criminal offense knowingly and willingly.

   1. If the individual was forced to commit or plan the criminal offense, they cannot be charged with ACC.

      1. Refer to Offenses Relating to Crimes Against Person to charge the individual who forced them to participate.

Accessory in Commission of a Crime shall be charged up to the same designation as the criminal offense that was committed, and shall be treated as such.
